These terms and conditions ("Terms") govern the use of the website at pensa.website and the legal advisory services provided by Pensarae, a legal practice operating from 19 Jalan Burmah, 10050 George Town, Penang, Malaysia. By accessing this website or engaging our services, you agree to be bound by these Terms.
1. Definitions
- "We" / "Us" / "Our" — Pensarae, the legal advisory practice.
- "You" / "Client" — any individual who contacts us, uses the website, or engages our services.
- "Services" — the legal advisory services described on this website, including Initial Pension Position Reviews, Representation in Pension Contribution Disputes, and Advisory on Pension Arrangements for Family Members.
- "Engagement" — a formalised arrangement under which we have agreed to provide Services to you.
- "Website" — the website located at pensa.website.
2. Acceptance of terms
By using this website or requesting our Services, you confirm that you are at least eighteen years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person (for example, a family member), you confirm that you have authority to do so.
3. Nature of our services
Pensarae provides legal advisory services in relation to pension matters under Malaysian law. Our Services are described on this website and are provided under a written engagement letter that specifies scope, fees, and terms applicable to each individual matter. Nothing on this website constitutes legal advice. It is general information only. Formal legal advice is provided only under an Engagement.
Our Services are available to individuals across Malaysia. We do not impose geographic restrictions on initial enquiries, though the nature of representation work may require attendance or correspondence within Malaysia.
4. Initial enquiries
An initial enquiry submitted through the website contact form or by telephone does not constitute an Engagement and does not create a solicitor-client relationship. We will assess each enquiry and indicate whether and how we are placed to assist. There is no charge for an initial enquiry.
5. Engagement and fees
An Engagement is formalised by our written confirmation following receipt and agreement of the engagement letter. Fees for each Service are published on this website and apply to the scope of work described. The fees are:
- Initial Pension Position Review: RM 780
- Representation in Pension Contribution Disputes: RM 2,740
- Advisory on Pension Arrangements for Family Members: RM 1,420
Where a matter develops beyond the scope described, we will discuss the implications with you before undertaking any additional work. No additional charge is incurred without your prior agreement. Payment terms are set out in the engagement letter.
6. Client responsibilities
You are responsible for providing accurate and complete information and documentation relevant to your matter. Delays or errors arising from incomplete instructions or documents provided by you are not our responsibility. You are responsible for making decisions in relation to your own matter; we provide advice and analysis, but decisions remain yours.
7. Confidentiality
All information shared with us in connection with a matter is treated as confidential and handled in accordance with our professional obligations and our Privacy Policy. We do not share client information with third parties except as required to carry out your matter (with your knowledge) or as required by law.
8. Intellectual property
All written summaries, submissions, and advisory documents prepared by us are our intellectual property until fees have been paid in full, at which point ownership of the document passes to you. The content of this website, including its text and design, is the property of Pensarae. You may not reproduce it without our written consent.
9. Disclaimers
We provide Services with reasonable care and skill, consistent with our professional obligations. However, we do not warrant that any particular outcome will be achieved. Legal advisory work involves matters of judgment and depends in part on the decisions of third parties (such as administering bodies) whose decisions we cannot control. The information on this website is provided for general informational purposes and does not constitute legal advice.
10. Limitation of liability
Our liability in connection with any Engagement is limited to the fee paid for that Engagement. We are not liable for indirect, consequential, or economic losses that are not a direct and foreseeable result of our advisory work. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
11. Termination
Either party may terminate an Engagement by written notice. If you terminate, fees for work completed to that point are payable. If we terminate — which we would do only for reasons of professional propriety — we will give you reasonable notice and provide a summary of the position of your matter at termination so that you can engage alternative assistance without disruption.
12. Governing law and disputes
These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with an Engagement will first be addressed through direct communication between the parties in an attempt to reach an amicable resolution. If resolution cannot be reached informally, the dispute shall be subject to the jurisdiction of the courts of Malaysia.
13. Changes to terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of this website after an update constitutes acceptance of the revised Terms. Changes do not affect Engagements already in progress unless agreed in writing.
14. General
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of our right to do so in the future. These Terms, together with any engagement letter, constitute the entire agreement between you and us in relation to the Services.
